1.1 The store conducts global sales

1.2. The customer can place an order via the form available on the store’s website. When placing an order, the customer states the number of items and the place and method of delivery.

1.3. An order via the website may be placed by the Client 24 hours a day, 7 days a week.

1.4. The order is executed under the condition that the customer provides the data necessary for its verification. After placing the order, the customer receives a confirmation to the e-mail address provided. The store may refuse to process the order when it raises doubts as to the veracity of the given data or the method of payment for the purchased goods.

1.5. Registration and creating an account is not a prerequisite for placing an order in the store. The customer can place an order through the online store without prior registration

1.6. Shop and customer are bound by data contained on the Store’s website at the time of placing the order. Speech in particular about such parameters as: price, shipping costs, date and method of delivery.

1.7. The store may withdraw from the contract within 14 days in the event of unavailability of the goods in the warehouse. In the event that the Customer has already paid for the ordered goods, the Store will return the funds paid within 5 calendar days from the moment the order is canceled.

1.8. Until the shipment of the goods, the customer has the right to make modifications in the order. Changes can be made via e-mail address or by phone. The changes may concern the number of products ordered, the place of dispatch, the data appearing on the invoice. The customer may also withdraw from the purchase. The funds paid In advance are returned to the Customer within 7 working days from the date of notification of the resignation.

1.9. Prices visible on the store’s website are given in dollars and include tax on goods and services (VAT).

1.9. The order may be canceled in a situation where, within 4 business days from the day of placing the order, the payment to the Store’s account has not been received. The day of receipt of the Agreement concluded via the Online Store is the day of receipt of the shipment by the Buyer.

Delivery of goods

2.1. The goods purchased in the Store are delivered to the customer at the address provided by him. The delivery takes place via Poczta Polska. Along with the goods, the customer receives a dokument confirming the purchase (invoice).

2.2. The Shop shall not be liable for delays in delivery or lack thereof resulting from incorrect data provided by the Customer.

Payment for the goods

3.1. The customer can pay for the ordered goods using paypal

Return and exchange of goods

4.1. The customer may return the purchased goods within 14 days from the date of receipt of the goods. This right is due to the Customer In accordance with art. 7 par. 1 of the Act of March 2, 2000 on the protection of consumer rights and liability for damage caused by a dangerous product (Journal of Laws of 2000 No. 22 item 271, as amended) (the “Act”).

4.2. In the event of withdrawal from the contract on the basis described in section 4.1, the Customer is obliged to return the complete goods without any signs of use and the Store is obliged to return the amount paid by the Customer.

4.3. The store does not refund to the customer the funds paid for transporting the goods to the customer.

4.4. The right to return the goods indicated in point 4.1 is not available to the Customer in the cases specified in detail in art. 10 para. 3 of the Act.

4.5. The Customer, with the prior consent of the Store, may replace the product with another one within 14 days from the date of recept of the goods by the Customer. In this case, he should complete the Exchange / Return Form.

4.6. The customer, if the product sold has a defect, may:

  1. a) submit a statement requesting a price reduction;
  2. b) submit a statement on withdrawal from the Agreement;
  3. c) demand replacement of the product with no defects;

4.7. The exchange of goods results in the fact that the previously paid amount is credited towards the amounts due under the new order. The difference in amounts between the new and the original order is paid by the Customer (when the new order is for a higher amount) or returned by the Shop (when the new order is for a lower amount).

4.8 The Store does not receive shipments sent to it for COD, and is not responsible for the costs associated with such shipments.

Product complaint

5.1. Store responds to customers who are consumers for non-compliance of the goods with the contract in accordance with the Act on special terms of consumer sales and amending the Civil Code of July 27, 2002 (Journal of Laws of 2002 No. 141, item 1176, as amended). For customers who are not consumers, the Store responds to the rules set out in the Civil Code.

5.2. By submitting a complaint, the Customer is obliged to send the goods together with the completed Complaint Form to the following address: Wodna 19, 58-420 Lubawka.

5.3. The customer receives information about the complaint within 14 days of its receipt. Information is sent by phone or via email.

Personal data protection

6.1. By placing an order in the store, the customer agrees to place his personal data in the database and for their processing for the purpose of the contract. Providing personal data by the customer and consent to their processing are necessary to complete the order by the store. The customer is liable for providing false personal data.

6.2. Personal data is protected in accordance with the Act of 29.08.1997 “On the Protection of Personal Data” (Journal of Laws No. 133, item 883) in a way that prevents access to them by third parties.

Final Provisions

7.1. Customers can access these Regulations at any time via the link placed on the main page of the Online Store.

7.2. The content of these Regulations may be changed after informing the Users about the scope of expected changes not later than within 14 days before their effective date.

7.3. The product information on the cap-boom.coml website does not constitute an offer within the meaning of the Civil Code.

7.4. The availability of information about products on the Store’s websites does not mean the availability of these products in the warehouse and the possibility of fulfilling the order.

7.5. All product names posted on the Store website are used for identification purposes and may be protected and reserved under the provisions of the Industrial Property Law Act (Journal of Laws No. 119 of 2003, item 1117).

7.6. Any disputes arising between the Seller and the Customer, who is a Consumer within the meaning of Article 221 of the Civil Code, will be resolved by a common court competent in accordance with the provisions of the Code of Civil Procedure.

7.7. Any disputes arising between the Seller and the Customer who is not a consumer within the meaning of Article 221 of the Civil Code shall be resolved by a common court having jurisdiction over the seat of the Store.

7.8. The name of the Online Store, the address at which it is available: www.cap-boom.com. All materials in it are subject to copyright and are protected by law. Using and distributing them without the consent of the Store owner is prohibited.

7.9. These Regulations are effective from April 1, 2018.

Refund and shipping policy

Delivery usually takes from 14 to 30 days. All orders are subject to product availability. If an item in your order is unavailable, we will ship you the part of your order that is available. When that item becomes available, we will ship you the rest of your order. Shipping costs for your order are non-refundable and are based on the weight of the items you order and your location. The date of delivery for your order may vary due to carrier shipping practices, delivery location, method of delivery and the quantity of items ordered, and in addition your order may be delivered in separate shipments. Additional shipping charges may apply depending on your location and the size of your order. You are responsible for all taxes applicable to the delivery of your order, including sales tax, value added tax, custom duties and excise duties. If there is any damage to the items that you ordered on delivery, you must contact us within 5 days from receipt of your order.

If you are not 100% satisfied with your purchase, you can either return your order for a full refund or exchange it for something else. You can return or exchange your purchase for up to 14 days from the purchase date. Returned or exchanged products must be in the condition you received them and in the original box and/or packaging.
